In this unpublished decision, the Board of Immigration Appeals (BIA) terminated proceedings upon finding the respondent had not been sentenced to at least one year in prison for his forgery conviction under Ga. Code. 16-9-1(b). The Board took administrative notice of an order from the state trial judge clarifying that the respondent’s entire sentence was to be served on probation.
