IRAC is pleased to release an updated version of its Index of Unpublished Decisions of the Board of Immigration Appeals, which now contains links to decisions issued through October 8, 2014. The Index is organized by subject matter and contains links to helpful rulings selected from an ongoing review of more than 8,500 unpublished BIA decisions.
Among other newly added rulings, the updated version of the Index now contains links to recent decisions stating:
• Third degree burglary under Conn. Gen. Stat. Ann 53a-103 is not an aggravated felony “burglary offense”
• Respondents seeking derivative citizenship under former INA 321(a) need not submit court-issued documentation establishing their parents legal separation
• Change of venue is appropriate if a respondent and his or her witnesses live in another jurisdiction
• A respondents who was a flight risk merited a $5,000 bond
• Allegations in an order of restitution cannot be considered under the modified categorical approach
